The law focuses on transparency and disclosure requirements for high-risk AI systems, defined as those used in consequential decisions affecting Colorado residents. Covered areas include employment, housing, credit, education, and healthcare. Companies deploying high-risk AI systems must disclose when AI is being used to make or assist in decisions that significantly affect individuals.
The law also requires developers and deployers of high-risk AI to conduct impact assessments and take steps to identify and mitigate algorithmic discrimination. Consumers have the right to know when AI influenced a decision about them and to appeal those decisions in certain circumstances.
The Colorado law arrives as federal AI regulation remains fragmented. The Trump administration has taken a different approach at the national level, focusing on reducing regulatory barriers to AI development while increasing government oversight of specific national security applications.
At the federal level, the administration recently required both Anthropic and OpenAI to obtain federal approval for each new customer of their most powerful AI models. The administration also ordered Anthropic to disable access to its most advanced models for non-U.S. users, citing national security concerns.
Separately, OpenAI and Broadcom unveiled "Jalapeño," OpenAI's first custom AI inference chip, on June 25. The chip was developed in a nine-month cycle using AI-assisted design processes and is intended to reduce OpenAI's dependence on Nvidia GPUs for routine model operations.
Qualcomm also revealed its "Dragonfly C1000" CPU, designed for agentic AI workloads in data centers, with Meta signed on as an early partner.
