FTC Sues Hims and Hers for Sharing Patient Health Data with Meta and Snap

The Federal Trade Commission, joined by the states of Utah and California, filed a lawsuit against telehealth provider Hims and Hers in July 2026.

The complaint alleges the company shared sensitive patient health data with advertising platforms including Meta, Snap, Microsoft, Pinterest, Reddit, and X without user consent. According to the FTC, Hims and Hers used pixel-sized tracking technologies on its website to capture and transmit user actions to these third parties. The company also allegedly shared lists of specific customers with advertising platforms.

These actions allegedly violated the company's own privacy policy, which promised to protect patient information and maintain the confidentiality of medical conditions.

Beyond privacy concerns, the lawsuit accuses Hims and Hers of deceptive billing and subscription practices. The FTC claims the company charged consumers for prescriptions almost immediately after they submitted an intake form, often without providing the promised consultation with a medical provider.

The complaint also alleges the company made it intentionally difficult to cancel recurring subscriptions. Even after adding an online cancellation option in 2023, the company allegedly obscured the cancellation button and required users to navigate through multiple steps and misleading menu options.

The lawsuit was filed in the U.S. District Court for the Northern District of California. Hims and Hers called the allegations baseless and said it intends to defend its position in court. Shares of the company fell nearly 15 percent following the news.
